Terms of Use

1. Acceptance of Terms

By creating an account or using ApzSign ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Service Description

ApzSign provides electronic document signing, delivery, and management tools. The Service includes subscription plans with varying feature limits, optional add-ons, and prepaid credit packs for document and SMS transactions.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials. You must provide accurate information during registration. You are liable for all activity under your account. Notify us immediately of any unauthorized access.

4. Subscriptions & Billing

Paid subscriptions are billed monthly in advance via PayFast (or such other payment provider as we may introduce). Your subscription renews automatically each month until you cancel. You may upgrade your plan at any time; the first charge on an upgrade is pro-rated for the remaining days in your current billing cycle, and full monthly billing begins from the next cycle.

No refunds: All subscription payments are non-refundable. No partial, pro-rated, or full refunds are issued for any reason, including cancellation, downgrade, or unused portions of a billing period.

Prepaid credit packs (document or SMS credits) do not expire while your account remains active but are non-refundable and non-transferable.

5. Cancellation & Data Retention

You may cancel your subscription at any time from the Plans & pricing page or your Account page. Upon cancellation, your paid plan remains active until the end of your current billing period. After the billing period expires, your account reverts to the Free tier.

No refunds are issued for the remaining portion of a billing period after cancellation. Downgrading is handled by cancelling your current plan; you may subscribe to a different plan once the current period ends.

You are responsible for exporting or downloading all documents and contracts before your plan expires. After your paid plan ends, data is retained for 30 days, after which it may be permanently deleted. ApzSign is not responsible for data loss following cancellation or plan expiry.

6. Acceptable Use

You may not use the Service for any unlawful purpose, to transmit harmful code, to infringe intellectual property rights, or to send unsolicited communications. We reserve the right to suspend or terminate accounts that violate these terms.

7. Electronic Signatures

ApzSign facilitates the creation of electronic signatures. While electronic signatures are legally recognized in many jurisdictions (including under the Electronic Communications and Transactions Act 25 of 2002 in South Africa), it is your responsibility to ensure that your use of electronic signatures complies with applicable laws and that the signed documents are enforceable in your jurisdiction.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, ApzSign shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities. Our total liability is limited to the fees you have paid in the 12 months preceding the claim.

9. Intellectual Property

All content, trademarks, and software associated with the Service are the property of ApzSign or its licensors. You retain ownership of documents you upload or create using the Service.

10. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
